1. About these terms
These terms are an agreement between you and Technical Guider, a sole proprietorship of Shivam Gupta, which operates Hisab Time (“Hisab Time”, “we”, “us”, “our”). Registered address: Shree Nagar, Rani Bagh, Pitampura, Delhi 110034, India.
By installing or using the Hisab Time app, our website hisabtime.com or our GSTIN auto-fill service (together, the “Service”), you agree to these terms and to our Privacy policy. If you use Hisab Time for a company or firm, you confirm that you are allowed to accept these terms on its behalf. If you do not agree, please do not use the Service.
2. Who can use Hisab Time
- You must be at least 18 years old and able to enter into a binding contract under Indian law.
- Hisab Time is made for business use in India, such as preparing GST invoices and keeping business records. It is not meant for personal or household use.
- You must not use Hisab Time if any applicable law prevents you from doing so.
3. Your licence to use the app
We give you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use Hisab Time on devices you own or control, for your business, in line with these terms.
You may not copy, modify, sell, rent or redistribute the app; reverse engineer or decompile it, except where the law expressly allows it; remove our notices or branding; or use Hisab Time to build a competing product.
4. Your data and your responsibilities
Your data stays yours
Your business data is stored on your own device and belongs to you. Because we do not hold a copy, you are responsible for keeping your device secure and for making backups. We cannot recover data that is lost when a device is lost or reset, or when the app is uninstalled.
You are responsible for your invoices
Hisab Time calculates tax from the information you enter: rates, HSN/SAC codes, place of supply, prices and discounts. You are responsible for checking every invoice and document before you issue it, and for your business’s tax treatment, returns and payments.
Hisab Time is a software tool, not an adviser. It does not give tax, accounting or legal advice. For advice about your situation, please consult a qualified professional, such as a chartered accountant.
Information about other people
When you record details about your customers or suppliers, or send them invoices and reminders, you are responsible for having a lawful reason to do so and for the messages you send.
5. GSTIN auto-fill and third-party services
GSTIN auto-fill fetches a business’s registered name, address and status from a third-party GST data provider. These results come from outside sources, are provided “as is”, and may sometimes be outdated, incomplete or unavailable. Please verify them before you rely on them on an invoice.
Each successful search has a small cost, paid from a prepaid wallet of auto-fill credits, and a search is charged only when details are actually returned. Checking whether a GSTIN is correctly formed is free.
Hisab Time also works alongside services run by other companies, such as WhatsApp, email apps, Google Fonts, cloud drives and Razorpay. Their own terms apply when you use them, and we are not responsible for how they operate.
6. Acceptable use
When you use Hisab Time, you agree not to:
- use it for anything unlawful, including creating false or misleading invoices or evading tax;
- scrape, harvest or bulk-query our GSTIN service, or call our API from anything other than the Hisab Time app;
- attack, overload, probe or disrupt our servers, or try to get around security, usage limits or payment;
- resell or share access to auto-fill, or use it to build a database of businesses;
- send content through Hisab Time that is harmful, infringing or malicious; or
- pretend to be someone else, or misuse another business’s GSTIN.
We may limit or block access to online features, such as GSTIN auto-fill, if we see abuse.
7. Early access
Hisab Time is in early access. That means:
- it is free to use during early access;
- features may be added, changed or removed, and you may come across bugs; and
- we will tell you before any paid plan applies to you, and you will only ever be charged for something you choose to buy.
Please keep regular backups, especially during early access.
8. Paid plans, credits and payment
We plan to offer a paid Pro plan and prepaid GSTIN auto-fill credits, bought on hisabtime.com. When they launch:
- prices will be shown in Indian rupees on hisabtime.com before you pay, with GST added as applicable;
- payments will be processed by Razorpay, whose terms also apply to your payment;
- if a plan renews automatically, we will say so clearly at checkout, and you can cancel at any time; and
- if we change prices, we will tell you in advance, and the new price will apply only from your next billing period.
Cancellations and refunds are covered by our Refund and cancellation policy, and the delivery of digital purchases by our Delivery policy.
9. Intellectual property
The Hisab Time app, website, name, logo, invoice designs, text, graphics and software belong to us or our licensors and are protected by law. These terms do not give you any rights in them beyond the licence in section 3.
Your content stays yours. Your logo, business details and documents belong to you, and because they stay on your device, we take no rights in them.
If you send us feedback or ideas, we may use them to improve Hisab Time without any obligation to you.
10. Suspension and termination
You can stop using Hisab Time at any time by uninstalling the app. We may suspend or end your access to our online services, such as GSTIN auto-fill or purchases, if you seriously or repeatedly break these terms, if the law requires it, or if continuing would put other users or Hisab Time at risk. Where reasonable, we will tell you first.
Because your business data lives on your device, ending access to our online services does not delete it. Sections that by their nature should continue (such as intellectual property, disclaimers, limitation of liability, indemnity and governing law) continue to apply after termination.
11. Disclaimers
We work hard to make Hisab Time accurate and reliable, but the Service is provided “as is” and “as available”. To the extent the law allows, we make no promise that it will be uninterrupted or error-free, that it will suit every purpose, or that GSTIN results and calculations will always be complete and correct. Nothing in these terms affects rights you have under law that cannot be excluded.
12. Limitation of liability
To the extent the law allows:
- we are not liable for indirect, incidental, special or consequential losses, including loss of profit, revenue, goodwill or data, or tax interest and penalties arising from invoices or returns; and
- our total liability to you for all claims relating to the Service is limited to the total amount you paid us for Hisab Time in the 12 months before the event that gave rise to the claim.
Nothing in these terms limits liability that cannot be limited under Indian law, such as liability for fraud.
13. Indemnity
You agree to indemnify and hold harmless Technical Guider and the people who run Hisab Time against claims, losses and costs (including reasonable legal fees) arising from your misuse of the Service, the invoices and documents you issue, or your breach of these terms or of any law.
14. Governing law and disputes
These terms are governed by the laws of India. If a dispute arises, please write to us first at support@hisabtime.com, and we will try to resolve it informally within 30 days. If we cannot, the courts at Delhi, India will have exclusive jurisdiction.
15. Changes to these terms
We may update these terms from time to time, for example when paid plans or accounts launch. We will change the effective date at the top of this page, and for significant changes we will give notice on our website or in the app before they apply. If you keep using Hisab Time after the changes take effect, you accept the updated terms.
16. General
- These terms, together with our Privacy, Refund and cancellation, and Delivery policies, are the whole agreement between you and us about the Service.
- If any part of these terms is found to be unenforceable, the rest stays in effect.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer your rights under these terms without our consent. We may transfer ours as part of a merger, acquisition or reorganisation of our business.
